1. Scope

1.1. These general terms and conditions apply to all orders that customers place via the online shop of Breny Predators-Tackle.ch, Seeblickstrasse 6, 8738 Uetliburg, CHE-135.001.319, hereinafter referred to as predators-tackle.ch.

1.2. With the confirmed order, these general terms and conditions are deemed to have been accepted by the purchaser.

2. Offer and conclusion of contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order.

2.2 By clicking the (Order) button, the customer places a binding order for all products listed on the order page.

2.3 Immediately after receiving the order, predators-tackle.ch confirms the order by email. The purchase contract is concluded immediately for non-physical goods and upon delivery for physical goods.

3. Prices and shipping costs

3.1 The prices stated on the product page include VAT but exclude other price components (postage, packaging) and are in Swiss francs (CHF). The exact shipping costs are displayed to the customer during the ordering process.

3.2 No further taxes or costs apply.

3.3 The provider reserves the right to change the prices at any time. The prices published on the website on the order date apply to customers.

4. Delivery conditions

4.1 Delivery of physical goods only takes place within Switzerland. Deliveries abroad will only be processed upon request.

4.2 Unless otherwise stated in the offer, the delivery time for Switzerland is 1 to 3 working days. If a longer delivery period is necessary, the customer will be informed at the latest after this period has expired. If no information is provided, the customer is entitled to forego delivery.

4.3 If not all ordered products are in stock, predators-tackle.ch is entitled to make partial deliveries.

4.4 If the delivery of the goods fails due to the customer's fault despite three delivery attempts, predators-tackle.ch can withdraw from the contract. Any payments made will be refunded immediately.

5. Payment Terms

5.1 Payment is made for customers either by invoice, advance payment, Twint or credit card.

5.2 When paying by credit card or Twint, the customer's account is debited at the time of the order.

5.3 Offsetting against unrecognized or not legally established counterclaims of the customer is excluded.

5.4 The customer can only exercise a right of retention if the claims are based on the same contractual relationship.

5.5 Purchase on account with partial payment option (POWERPAY)
MF Group / POWERPAY, as an external payment service provider, offers the payment method “purchase on account”. With the individual invoice you can easily pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.
When the purchase contract is concluded, POWERPAY takes over the resulting invoice claim and handles the corresponding payment modalities. When purchasing on account, you also accept our general terms and conditions .

6. Retention of title

The goods remain the property of predators-tackle.ch until full payment has been made. Before ownership is transferred, pledging, transfer as security, processing or redesigning without the consent of predators-tackle.ch is not permitted.

7. Right of withdrawal

7.1 Consumers have the right to revoke the contractual declaration within 7 days of receiving the goods. The revocation must be sent in writing by email or letter to predators-tackle.ch. The time at which the cancellation is sent is decisive in ensuring that the deadline is met. A justification for the revocation is not necessary. The declaration of revocation must be sent to:

7.2 The exercise of the right of withdrawal leads to the conversion of the purchase contract into a reversal relationship, according to which the services received under the purchase contract must be reimbursed. The consumer must return the goods received with the original packaging to predators-tackle.ch within 7 days of declaring the cancellation. The consumer bears the costs for the return.

7.3 After receipt of the goods, the purchase price, if already paid, will be immediately refunded to the consumer. We reserve the right to deduct the purchase price to be refunded for possible damage or excessive wear and tear to the goods. No deduction will be made if the loss in value is due to the handling of the goods that is necessary to determine the type, quality and functionality of the goods. Predators-tackle.ch may refuse reimbursement until the goods have been received back or until the consumer has provided evidence that he has sent the goods back, whichever is earlier.

8. Warranty and Liability

8.1 Predators-tackle.ch guarantees that the goods correspond to the guaranteed properties, have no defects that affect their value or suitability for the intended use and correspond to the prescribed performance and specifications. Predators-tackle.ch reserves the right to remedy an existing defect or to deliver a defect-free item in the sense of a repair or replacement delivery.

8.3 If repairs or subsequent delivery fail, the customer is entitled to withdraw from the contract. This does not apply to insignificant defects. The customer's right to a reduction is excluded.

9. Passwords/Secrecy

For products made available online, the customer undertakes to treat the access data provided to the system and the passwords set up for it as strictly confidential and with the utmost care. Predators-tackle.ch reserves the right to immediately terminate the user authorization if the multiple use of access data by an individual is discovered.

10. Copyright / Copyright

The content and structure of the products published by predators-tackle.ch and the entire internet offering are protected by copyright. The use of contributions and work aids for the customer's own use is permitted, but full or partial commercial distribution requires the express consent of the copyright owner.

11. Liability

Predators-tackle.ch excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes. 12. Place of jurisdiction and applicable law

The contractual relationships between the customer and predators-tackle.ch are subject to substantive Swiss law. The ordinary court in the canton of St.Gallen is responsible for disputes arising from these contractual relationships.

13. Final provisions

If parts of these general terms and conditions are invalid, this will not affect the validity of the remaining provisions. The relevant statutory provisions apply accordingly in place of the invalid provisions.
